In view the ongoing outbreak of COVID-19 (Corona Virus) and concern of the logistics for COVID-19 management particularly during last couple of weeks and that masks (2 ply & 3 ply surgical masks, N95 masks) and hand sanitizers have been noted to be either not available with most of the vendors in the market or are available with great difficulty at exorbitant prices, Government has notified an Order under the Essential Commodities Act to declare these items as Essential Commodities up to 30th June, 2020 by amending the Schedule of the Essential Commodities Act, 1955. It has also issued an advisory under the Legal Metrology Act. Under the E.C Act, after discussions with the manufacturers, States can ask them to enhance their production capacity of these items, to make the supply chain smooth, while under the L.M. Act the States can ensure sale of both the items at MRP.
On these two items, the States may now notify the Central order in their official Gazette, also issue their own orders under the EC Act to that effect and take necessary actions as per the situation prevailing in the respective States. Under the EC Act, powers of the Central Government have already been delegated to the States by way of orders during 1972 to 1978. The States/UTs, therefore may take action against the offenders under the EC Act and PBMMSEC Act. An offender under the EC Act may be punished with an imprisonment upto 7 years or fine or both and under the PBMMSEC Act, he can be detained for maximum of 6 months.
The decision would empower the Government and States/UTs to regulate production, quality, distribution etc. of masks (2 ply & 3 ply surgical masks, N95 masks) and hand sanitizers and to smoothen the sale and availability of these items and carry out operations against orders speculators etc. and those involved in over pricing, blackmarketing etc. It will enhance the availability of both the items to the general people at reasonable prices or under MRP. The States are also advised to give publicity of State Helplines for registering complaints by the consumers of the above two items. आवश्यक वस्तु अधिनियम के तहत अब मास्क और हैंड सैनिटाइजर भी
विगत कुछ सप्ताहों के दौरान कोविड-19 (कोरोना वायरस) के मौजूदा प्रकोप और कोविड-19 प्रबंधन के लिए लॉजिस्टिक संबंधी चिंताओं के परिप्रेक्ष्य में तथा यह भी देखते हुए कि मास्क (2 प्लाई एवं 3 प्लाई सर्जिकल मास्क, एन95 मास्क) और हैंड सैनिटाइजर या तो बाजार में अधिकांश विक्रेताओं के पास उपलब्ध नहीं है अथवा बहुत अधिक कीमतों पर काफी मुश्किल से उपलब्ध हो रहे हैं, सरकार ने आवश्यक वस्तु अधिनियम, 1955 की अनुसूची में संशोधन करते हुए, इन वस्तुओं को दिनांक 30 जून, 2020 तक आवश्यक वस्तु अधिनियम, 1955 के तहत आवश्यक वस्तु के रूप में घोषित करने के लिए एक आदेश अधिसूचित किया है। सरकार ने विधिक माप विज्ञान अधिनियम के तहत एक एडवाइजरी भी जारी की है। आवश्यक वस्तु अधिनियम के तहत, राज्य, विनिर्माताओं के साथ विचार-विमर्श करके उनसे इन वस्तुओं की उत्पादन क्षमता बढ़ाने, आपूर्ति श्रृंखला को सुचारू बनाने के लिए कह सकते हैं जबकि विधिक माप विज्ञान अधिनियम के तहत राज्य इन दोनों वस्तुओं की अधिकतम खुदरा मूल्य (एम.आर.पी.) पर बिक्री सुनिश्चित कर सकते हैं।
इन दोनों वस्तुओं के संबंध में, राज्य अपने शासकीय राजपत्र में अब केंद्रीय आदेश को अधिसूचित कर सकते हैं और इसके लिए आवश्यक वस्तु अधिनियम के तहत अपने स्वयं के आदेश भी जारी कर सकते हैं और संबंधित राज्यों में व्याप्त परिस्थितियों के अनुसार कार्रवाई कर सकते हैं। आवश्यक वस्तु अधिनियम के तहत, केंद्र सरकार की शक्तियां वर्ष 1972 से 1978 के आदेशों के माध्यम से राज्यों को पहले ही प्रत्यायोजित की जा चुकी हैं। अतः, राज्य/संघ राज्य क्षेत्र आवश्यक वस्तु अधिनियम और चोरबाजारी निवारण एवं आवश्यक वस्तु प्रदाय अधिनियम के तहत उल्लंघनकर्ताओं के विरूद्ध कार्रवाई कर सकते हैं। आवश्यक वस्तु अधिनियम के तहत किसी उल्लंघनकर्ता को 7 वर्ष के कारावास अथवा जुर्माने अथवा दोनों से दंडित किया जा सकता है तथा चोरबाजारी निवारण एवं आवश्यक वस्तु प्रदाय अधिनियम के तहत, उसे अधिकतम 6 माह के लिए नजरबंद किया जा सकता है।
यह निर्णय सरकार और राज्यों/संघ राज्य क्षेत्रों को मास्क (2 प्लाई एवं 3 प्लाई सर्जिकल मास्क, एन95 मास्क) और हैंड सैनिटाइजर के उत्पादन, गुणवत्ता, वितरण आदि को विनियमित करने और इन वस्तुओं की बिक्री और उपलब्धता को सहज बनाने तथा आदेश के उल्लंघनकर्ताओं आदि एवं इनके अधिमूल्यन, कालाबाजारी आदि में शामिल व्यक्तियों के विरूद्ध कार्रवाई करने के सशक्त बनाएगा। इससे आम जनता को दोनों वस्तुओं की उचित कीमतों पर अथवा अधिकतम खुदरा मूल्य (एमआरपी) की सीमा में उपलब्धता बढ़ेगी। राज्यों को उपरोक्त दोनों वस्तुओं के संबंध में उपभोक्ताओं द्वारा शिकायतें दर्ज कराने के लिए राज्य उपभोक्ता हेल्पलाइन का प्रचार करने की सलाह भी दी जाती है। इस संबंध में उपभोक्ता अपनी शिकायतें राष्ट्रीय उपभोक्ता हेल्पलाइन नम्बर 1800-11-4000 पर तथा ऑनलाइन शिकायतें www.consumerhelpline.gov.in, विभाग की वेबसाइट www.consumeraffairs.nic.in, [email protected] और [email protected], [email protected] पर भी दर्ज करा सकते हैं।
